Art Festival Rules 2006

In addition to the requirement that all installations and operations shall comply with Rhode Island Uniform Fire Code Chapter 10.16 as well as any other applicable chapters of the RI Fire Safety Code the following requirements shall be in force for this event:

           

Food Court and surrounding area

Note:   These rules will apply to any area on or adjacent to the Art Festival grounds being used for the preparation and/or serving of food during Art Festival weekend.

 

  • There shall be 20 feet clear path for fire equipment around the food court including an entrance for firefighters and equipment. This area shall be maintained clear of all objects such as tables, chairs etc. at all times.

 

  • There shall be a clear space of sixty inches (60”) between food vendor trailers and other structures and one hundred and twenty inches (120”) for tents measured between stake lines.

11.11.3       Location and Spacing.

11.11.3.1              There shall be a minimum of 3050 mm (120 in.) between stake lines.

11.11.3.2                  Adjacent tents shall be spaced to provide an area to be used as a means of emergency egress. Where 3050 mm (120 in.) between stake lines does not meet the requirements for means of egress, the distance necessary for means of egress shall govern.

Note:            If a tent does not have any cooking or heating appliances and the public is not allowed into the tent then they will be required to maintain the sixty inch (60”) clearance.

 

  • There shall be at least a sixty inches (60”) clearance between any propane tank and a tent, supply line must be protected and will not be in a pathway.

11.11.6.1.3              Containers for liquefied petroleum gases shall be installed not less than 1525 mm (60 in.) from any tent and shall be in accordance with the provisions of NFPA 58, Liquefied Petroleum Gas Code.

 

  • Cooking shall not be permitted in tents and the cooking facilities shall be at least 10’ from any tent.

Exception:            Any tent 110 square feet or smaller with no side walls and containing no frying equipment and minimal grilling equipment will be allowed to cook inside a tent if the operations plans have been approved by the Authority Having Jurisdiction (AHJ).  Plans will include, but may not be limited to, fire extinguisher requirements and locations, plans which show the operation under the tent, where the propane tank will be located and how supply lines will be protected.

Note:            Plans must be submitted for approval as early as possible to the Fire Marshal’s Office at North Scituate Fire Department, 201 Danielson Pike; but no later than August 31, 2005. 

 

  • Any cooking, preparation and/or sales area in the food court shall have fire extinguishers that meet NFPA 10 and NFPA 96 requirements for quantity, size and types of extinguishers.

 

A document from a licensed Fire Extinguisher distributor detailing the exposure and his/her recommendation on type, size and number of extinguishers must be available on Saturday Morning.  A true copy must be presented to the Fire Marshal for inclusion in files.

 

  • Each food court premises shall have at least 1 person trained in the use of the fire extinguishers present at all times.

Training must be approved by the AHJ prior to any classes and shall include lecture and practical use of extinguishers.

 

  • All tent fabric shall be flame resistant in accordance with NFPA 101.11.11.2

11.11.2       Flame Resistance.

11.11.2.1  All tent fabric shall be flame resistant in accordance with 10.3.1.

11.11.2.2              One of the following shall serve as evidence that the tent fabric materials have the required flame resistance:               

(1)             The AHJ shall require a certificate or other evidence of acceptance by an organization acceptable to the authority having jurisdiction.

(2)             The AHJ shall require a report of tests made by other inspection authorities or organizations acceptable to the authority having jurisdiction.

Note:            This means that at time of inspection (Friday Night or Saturday morning) the paperwork proving the tent conforms to 10.3.1 of NFPA 101 shall be presented to the inspector.

 

  • Propane Cylinders installed alongside of buildings shall be located and installed so that the discharge from the cylinder pressure relief device is at least 3 feet (1 m) horizontally away from any building opening that is below the level of such discharge (i.e. doors etc).  The discharge from cylinder pressure relief devices shall be located not less than 5 feet (1.5 m) in any direction away from any exterior source of ignition, openings into direct-vent appliances or mechanical ventilation air intakes.

 

  • All propane tanks must be on a flat surface and secured.

11.11.6.1.4              Tanks shall be secured in the upright position and protected from vehicular traffic.

 

 

  • All propane tanks shall not be left unattended (without a fire watch).  This means that propane tanks must be picked up on Monday after the end of the day’s activities or a fire watch must be posted.

 

Artist, craft, Antique and other venues

Note:   These rules will apply to any area on or adjacent to the Art Festival grounds if not being used for the homeowner or business owners personal use.

 

  • Pathways used as a means of egress from artist, craft, antique or any other venue shall be at least 5’ clear width.  Clear width will be measured between rows of tents or other structures between side walls and/or overhangs.

 

  • There will be a sufficient number of exits to be determined by the AHJ from display area(s).  The organization running the event is responsible for providing the AHJ with plans that describe pathways, exits and dimensions of each of the components of the display area(s).  Plans must be submitted for approval as early as possible to the Fire Marshal’s Office at North Scituate Fire Department, 201 Danielson Pike; but no later than August 31, 2005. 

 

  • The areas where art, craft, antique or any other display shall be considered a non-smoking area and shall have proper signage posted.

11.11.4.2                  Where prohibited by the authority having jurisdiction, smoking shall not be permitted in any tent.

 

Note:            Because of the way the display areas are arranged, the AHJ has interpreted this rule to mean all areas in and around display tents shall be included in the no smoking area. 

 

The North Scituate Fire Department reserves the right to correct any issue the Chief of the North Scituate Fire Department or his designee, the Local Fire Marshals or the R.I. State Fire Marshals office may find during the event.
